Creative Partner Agreement

This Creative Partner Agreement ("Agreement") is entered into between you ("the Creative Partner") and HFC Publishers LLC, with the following address:

HFC Publishers reserves the right to periodically update this Creative Partner Agreement. Creative Partners, by utilizing the HFC Publishers website and availing its services, acknowledge and agree to be bound by this Creative Partner Agreement. Continued use of the service following policy changes implies acceptance of the updated terms.

Purpose of Agreement:

This Agreement serves the following purposes:

1. Subject and Payment:

The Creative Partner agrees to be a member of HFC Publishers for the following purposes: To provide book authors with creative services such as Editors, Ghostwriters, Formatting Support, Book Cover designers, Illustrators, etc. The Creative Partner will create and display their profile on the online platform of HFC Publishers (hfcpublishers.com) to showcase their skills, share their portfolio, and present their previous work experience to book authors or individuals with book concepts. For this purpose, a monthly subscription fee, as per the Subscription Policy, is payable to HFC Publishers. No other commission for the Creative Partner exists.

2. Day-To-Day Operation:

Both parties shall provide their full-time services and best efforts in the context of this partnership. HFC Publishers is responsible for maintaining a running platform with an evolving audience, while The Creative Partner guarantees adequate professional competency in their field(s), proven by a university degree and/or certificates. The Creative Partner acknowledges HFC Publishers' right to check their professional competence with documents in case of author complaints. The Creative Partner understands that HFC Publishers cannot guarantee work, as it depends on the current demand for that type of work.

The Creative Partner commits to communicating directly with authors seeking professional services through the HFC Publishers platform (hfcpublishers.com) and assisting them in the best possible way. Furthermore, The Creative Partner confirms receiving payment directly from the author without involving HFC Publishers in any disputes. By utilizing the HFC Publishers website (hfcpublishers.com) and subscribing to its services, Creative Partners acknowledge and are bound by this Agreement. Continued use of the service after Agreement changes implies acceptance of the updated terms.

Creative Partners are obligated to read and adhere to the AI Copyright Policy of HFC Publishers.

Creative Partners are required to actively contribute to maintaining and enhancing the positive reputation of HFC Publishers. This involves conducting themselves in a professional and ethical manner when interacting with the platform, its authors, and fellow Creative Partners. This obligation encompasses refraining from engaging in activities that could tarnish the image of HFC Publishers and complying with the established guidelines and standards set forth by the platform. Upholding the good name of HFC Publishers reflects not only on individual Creative Partners but also contributes to fostering a positive and trustworthy environment within the broader literary community associated with the platform.

3. Term/Termination:

The term of this Agreement aligns with the subscription period of the Creative Partner. If the Creative Partner fails to prove professional competence, HFC Publishers has the right to terminate the contract immediately without refunding the subscription fee.

4. Disputes:

This Creative Partner Agreement shall be governed by the laws of the State of Delaware. Disputes shall be settled through arbitration following the rules of the American Arbitration Association, and the judgment rendered may be entered in any court with jurisdiction.

5. Withdrawal:

The Creative Partner has the liberty to cancel their subscription and discontinue rendering services to collaborate with authors at any time without prior notice.

6. Indemnities:

To shield HFC Publishers from potential legal claims, The Creative Partner undertakes to indemnify, defend, and hold harmless HFC Publishers and its representatives from various claims, including those related to unsatisfactory work, ownership, libel, slander, plagiarism, privacy violations, copyright infringement, and similar issues stemming from their work with authors.

7. Confidentiality:

Unless compelled by a court order or subpoena, both parties are obligated to maintain the confidentiality of the terms outlined in this agreement. They are prohibited from divulging any provisions or information obtained through this agreement to third parties. However, disclosure to an accountant or attorney is permissible, provided that such professionals agree to abide by the terms of this agreement and that the disclosure is for the purpose of seeking advice or guidance.
